Terms of Service

Last updated: 18 October 2026

BoardBurst is the classroom board quiz game for classrooms provided by a solo member, trading as BoardBurst ("we", "our", "us"). These terms govern your use of the service and your contract with BoardBurst. By creating an account or continuing to use the service you agree to these terms. If you don't agree, please don't use BoardBurst.

Before you agree

  • Accounts are for adults aged 18+, not students.
  • You keep copyright in your resources. Only if you separately give publishing permission can an approved Discover copy and its media stay after you delete your quiz or account. Private quizzes and pupil results are not covered.
  • Only upload materials you have rights to use. Check accuracy, media, age suitability and safeguarding before teaching; review and spelling suggestions are not guarantees.
  • Before real pupil homework, obtain school approval, a lawful basis, privacy information and a written processing agreement. Minimise identifiers, protect links and exports, and follow retention rules.
  • We use security safeguards, but no online service is risk-free. You are responsible for your own unlawful uploads or misuse; BoardBurst remains responsible for its own legal duties. Statutory rights are not waived.
  • Pro renews until cancelled. Paddle handles payments, cancellations and refunds under its published terms.

This is a summary, not a replacement for the full policies: Terms of Service, Privacy Policy, Refund Policy and School data protection.

1. Accounts

  • You must be aged 18 or over and register as a teacher, school staff member or other adult using BoardBurst for educational purposes. Student accounts are not permitted.
  • Provide your age and school or workplace accurately. Adults who do not work at a school or workplace may enter “Independent adult”. These details are self-declared; registration is not proof of a verified teacher, employer or identity.
  • Confirm your adult status, agree to these Terms and acknowledge the Privacy Policy when registering. We record the policy version and agreement date. Accounts created before this requirement are not retrospectively age-verified.
  • Do not create accounts on behalf of children or share your login with students. Adults remain responsible for supervising classroom use.
  • Keep your password safe. You are responsible for activity on your account.
  • If acting for a school or other organisation, you must have authority for your use and any commitments you make on its behalf. A registration tick records your agreement to the Terms and acknowledgement of our privacy notice; it is not consent on behalf of pupils, a data-processing agreement or permission to publish private content.

2. Free and Pro plans

  • Free: with a free adult account, play every classroom community quiz, create up to 5 custom quizzes, use printable A–D cards and Bank it or Risk it rounds. Pro homework resources are separate.
  • Pro (£4.99/month or £49/year): unlimited custom quizzes, unlimited private storage & organisation, the Homework community, resource requests, holiday avatar skins and class report export.
  • Subscriptions renew automatically until cancelled. Cancelling keeps Pro until the end of the paid period, then your account returns to Free.
  • Payments are processed by Paddle, our merchant of record. Prices include VAT where applicable.
  • Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
  • Payment, billing, tax, subscription cancellation and refund mechanics are governed by Paddle's Buyer Terms. Refunds are handled under Paddle's Refund Policy; see our Refund Policy for how to request one.

3. Your content

  • You keep ownership of the quizzes, questions and media you create.
  • BoardBurst retains ownership of BoardBurst and its software, documentation and branding. Your plan gives you a limited, non-exclusive, non-transferable right to use the service; it does not transfer ownership of our intellectual property.
  • You grant us permission to store and display your content within the service — for example, showing a public quiz in the community library.
  • From 18 October 2026, submitting a classroom quiz for public review requires separate, explicit permanent publishing permission. By selecting that publishing checkbox, you grant BoardBurst, a non-exclusive, worldwide, royalty-free licence for the life of the relevant rights to retain an approved copy, host and display its questions and media, and allow teachers to play and duplicate it within BoardBurst. This is not a transfer of copyright. Deleting your personal copy or account does not revoke this licence or remove the approved Discover copy. Private quizzes and student homework submissions are not covered by this permission.
  • The new permanent-copy permission is not applied retrospectively to older submissions. Existing teacher submissions must be saved with the publishing checkbox before a permanent copy can be approved. BoardBurst may withdraw resources for safeguarding, legal or copyright reasons; contact boardburstsupport@gmail.com about removal or personal-data concerns. YouTube and other external media remain dependent on their original providers and can become unavailable.
  • Only share content you have the right to use (your own materials, licensed resources or media you have permission to share with other teachers).
  • Optional clip times select the part played in a quiz; they do not edit or delete the source, restrict access to the rest of it, or grant permission to use copyrighted material. YouTube playback depends on the original video's availability and embedding permissions.
  • Do not put personal or confidential information in community resources without a lawful basis and any required permission. Check the whole uploaded file, not only the selected excerpt. You must have rights for the intended use, including permanent sharing where you select that permission; approval does not clear third-party copyright.
  • Report copyright, privacy or safeguarding concerns to boardburstsupport@gmail.com with the resource link, the issue, your contact details and evidence of your rights or authority where relevant. We may restrict access, remove content, seek clarification and suspend accounts for repeated infringement. The publishing licence does not override data-protection rights, third-party rights or our ability to withdraw a resource.

4. Acceptable use

  • Content must be classroom-safe. Swearing, slurs, sexual content, discrimination and harassment are blocked automatically and are not allowed.
  • Quizzes you publish to the community library are reviewed before appearing publicly.
  • Don't attempt to break the service, access other people's data, or resell access to BoardBurst.
  • Do not use the service unlawfully, for fraud or spam, or to infringe intellectual property rights. Do not interfere with security through malware, unauthorised probing, scraping or attempts to bypass access controls.
  • Do not upload confidential school records, unnecessary pupil identifiers or sensitive pupil information. Do not reverse engineer, redistribute or circumvent the service's access or plan limits except where the law permits.

5. Homework & Requests communities

  • Homework resources are shared with Pro members for students to complete independently at home on their own phones, tablets or computers, not as classroom board games. They can also be printed as PDF worksheets, but are not offered for duplication or quiz download. Pro teachers assign homework with one shared link and code per assignment; students enter their name and class without registering, logging in or needing Pro.
  • Only the assigning teacher can view and export their students' names, classes, answers, scores and percentages, organised by class. Teachers must share access within their class, collect only necessary pupil details, provide appropriate pupil/parent privacy information, secure exported spreadsheets and meet their school's lawful-basis and safeguarding requirements. Codes, names and classes do not verify identity; shared access cannot guarantee one attempt per pupil and repeated attempts may appear separately. Closing an assignment stops access, and deleting it removes its code and results.
  • Students enter one first name or agreed single-word nickname and their class name or set themselves; do not request surnames or school names. A first name, class/set and homework results may still identify a pupil to their teacher and are not anonymous merely because BoardBurst does not know the school. Only the assigning teacher can access those results through their account, not other teachers, Pro members or students.
  • Before using real pupil data, obtain school approval, document the lawful basis, provide age-appropriate privacy information and agree a written data-processing agreement with BoardBurst. Your school should review subprocessors, storage locations, transfer safeguards and whether a data protection impact assessment is required. First-name-only entry does not remove these requirements. A checkbox is not pupil consent or a guarantee of compliance; do not collect unnecessary or sensitive details.
  • Assignments have a teacher-selected retention period of 7–90 days (default 30); access stops at expiry and daily cleanup removes the assignment and results within 24 hours. Existing assignments receive a maximum 90-day deadline from 17 October 2026 and require privacy approval before further student access. Teachers can correct identifiers, delete individual results, delete the assignment sooner, or replace leaked links. Secure exported spreadsheets and follow your school's retention rules; app deletion does not delete copies you exported. Backup retention must be agreed in the processing agreement.
  • Resource requests and comments are visible to all Pro members. Be constructive and professional; we may remove abusive posts.
  • The teacher or school is responsible for its decisions about lawful collection, notices, access, disclosures and exported copies. Serena Wright remains responsible for BoardBurst's own controller and processor obligations, appropriate security and compliance with agreed processing instructions. These Terms do not shift our own breaches or all data-protection risk onto you, replace an Article 28 agreement, or prevent complaints or compensation claims available under law.
  • Report suspected unauthorised access, leaked teacher credentials or privacy incidents promptly to boardburstsupport@gmail.com without sending pupil records or passwords. Close or replace affected homework links and involve your school's data-protection lead. BoardBurst will investigate and cooperate with schools and authorities as required, including notifying the relevant controller without undue delay where legally required. Statutory breach-reporting duties and deadlines still apply.
  • Read the Privacy Policy and School data protection guidance before collecting real pupil information. Do not proceed while the required school approval and processing arrangements are unresolved.

6. Ending your account

You can delete your account or individual quizzes at any time; approved community copies published with permanent permission remain in Discover, subject to legal and safeguarding removal. We may suspend or close accounts for material breach, non-payment, security or fraud risk, or repeated or serious policy violations.

Where reasonable we will explain restrictions and allow you to respond; urgent safeguarding, legal or security concerns may require immediate action. Export any records you lawfully need before requesting deletion. School-directed deletion, retention and backup handling are subject to the agreed processing arrangements and statutory rights. Pro payment, cancellation and refund rights remain governed by Paddle's terms and applicable law.

7. Disclaimers & liability

  • BoardBurst is provided "as is". We work hard to keep it reliable but don't promise it will be uninterrupted or error-free.
  • You are responsible for checking that content suits your class before playing it.
  • Resources, correct answers, explanations, spelling or grammar suggestions and automatic fixes may contain mistakes. Review all content, media and suggested edits yourself; moderation and approval are not an assurance of accuracy, copyright clearance or suitability. Learning activities are not a substitute for qualified professional advice or your school's safeguarding procedures.
  • We take appropriate technical and organisational security measures, but no system can guarantee absolute security or freedom from data loss, outages or third-party failures. This statement does not excuse a failure to meet our legal duties or to provide the service with reasonable care and skill.
  • If you use BoardBurst for business purposes, to the extent lawful, our aggregate liability arising from the service is limited to the fees you paid for BoardBurst in the 12 months before the event giving rise to the claim. To the same extent, we exclude indirect or consequential losses and business loss of profit, revenue, goodwill or opportunity. These limits do not apply where prohibited by law.
  • If you are a consumer, your statutory rights remain unaffected, including rights relating to reasonable care and skill and digital content. We do not exclude liability for foreseeable loss caused by our breach where consumer law requires us to compensate you.
  • Nothing excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. This includes data-protection rights and compensation to the extent a restriction would be unlawful.
  • You are responsible for loss or third-party claims caused by your unlawful uploads, infringement, misuse or breach, to the extent attributable to your actions. For business users only, you agree to reimburse reasonable, evidenced losses and costs arising from such third-party claims, to the extent permitted by law. We will notify you promptly, allow reasonable involvement in the defence and not agree a settlement imposing obligations on you without your consent. This does not cover our own breach, negligence or legal failures and does not apply to consumers.

10. Law and resolving concerns

These Terms are governed by the law of England and Wales. The courts of England and Wales may resolve disputes; consumers retain any mandatory protections and rights to bring proceedings in their place of residence. Contact us first where practical so we can try to resolve a concern, but this does not require you to waive rights, delay a regulatory complaint or miss a legal deadline.

If a provision is unenforceable, the remaining provisions continue so far as lawful. These Terms cannot guarantee protection against every claim or replace school-specific contracts. No delay in exercising a right waives it.

8. Changes

We may update these terms as the service evolves. Material changes will be highlighted on this page with a new "last updated" date. Changes affecting privacy, subscriptions, eligibility or community use will be reflected in the relevant legal pages. Where required, we will ask for renewed agreement; updates do not remove your statutory rights.
